Maverick reserves the right to make changes to any accommodation, tour itinerary, transportation or service in our itineraries. However, should Maverick need to substitute any accommodation, tour itinerary, transportation or service, we will endeavor to provide you with a comparable alternative in time, price and quality.

All tour and event prices are guaranteed once Maverick receives your first deposit. However, in the unlikely event of a substantial increase in costs due to increased fuel surcharges, tariffs, taxes, government fees or quasi-government fees, we reserve the right to add a surcharge, not to exceed 3% of the Maverick per person tour fee, to offset these types of imposed fees and taxes. These types of surcharges are unlikely but subject to change without notice at any time, and we reserve the right to add a surcharge only to newly enrolling guests and those who have not yet paid in full. If you have paid in full, your price is guaranteed, and we will not impose any additional surcharges.

If you must cancel your reservation, your cancellation fee and refund will be determined according to the schedule outlined below:

The cancellation and refund policy is in effect from the initial date of reservation with deposit, even before the full tour cost is paid. Cancellation of a reservation is effective on the date that written notification is received by Maverick Adventures.

We highly recommend at the time of booking to purchase independent travel insurance. If you need to cancel your reservation for a personal medical reason, you may be eligible to receive a reimbursement from your travel insurance provider, subject to the coverage and conditions of the insurance provider's "trip cancellation" policy. The Maverick refund schedule is independent of any personal travel insurance policy you purchase. But again, this is an extra layer of protection for you that is relatively inexpensive.

Exceptions to Maverick's cancellation policy cannot be made for any reason, including weather, terrorism, civil unrest or personal emergencies. There is no refund for arriving late or leaving a trip early. Single occupancy and internal air charges are considered part of the trip price and are subject to cancellation fees. Percentage charges are calculated on the total trip cost.

In most cases you may transfer from one trip to another up to 90 days before trip departure without penalty, after which time our cancellation policy applies.

Maverick packages may be transferred in writing to another guest for a $250 service fee, although no transfers can be accepted within 15 days of departure. Any airline tickets that are part of a Maverick package may not be transferred due to the carriers' restrictions beyond Maverick's control. The new guest must assume the cost of new airline tickets, if applicable.

Maverick Adventures Inc., their employees, shareholders, subsidiaries, affiliates, officers, directors, successors, agents, representatives, and assigns (collectively MAVERICK) does not own or operate any entity which provides, or is to provide, goods or services for your trip including, for example, lodging facilities, transportation companies, food service providers, equipment suppliers, etc. As a result, MAVERICK is not liable for any negligent or willful act or failure to ace of any such third person, or of any third party.

In addition, I understand and agree that during the trek, tour, expedition, or other trip in which I will participate, under the arrangements of MAVERICK and its agents, employees, associates, affiliated companies, or subcontractors, certain risks and dangers may arise, including, but not limited to, acts of God, the hazards of traveling in unsafe or politically unstable areas or under unsafe conditions, the dangers of civil disturbances and war, the forces of nature, dangers and risks inherent in sporting activities, the negligent or reckless acts or omissions of MAVERICK, its agents, employees, officers, directors, associates, affiliated companies, or subcontractors, travel by boat, automobile, train, ship, aircraft, or other means of conveyance, and accident or illness in remote places without access to medical facilities, transportation, or means of rapid evacuation and assistance. MAVERICK shall not be responsible for any injuries, damages, or losses caused to any traveler in connection with any of the above and/or terrorist activities, social or labor unrest, mechanical or construction failures or difficulties, diseases, local laws, climatic conditions, abnormal conditions or developments, or any other actions, omissions, or conditions outside the travel agent's control. Traveler assumes complete and full responsibility for, and hereby releases the agent from any duty of, checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety or security conditions at such destinations. In consideration of, and as a part of the payment for, the right to participate in such treks, tours, expeditions, or other activities and as a part of the payment for, the services arranged for me by MAVERICK and its agents, employees, associates, affiliated companies, or subcontractors, I DO HEREBY EXPRESSLY ASSUME ALL OF THE ABOVE RISKS, including, to the extent permitted by law, the risk of negligent or reckless acts or omissions of MAVERICK, its agents, employees, officers, directors, associates, affiliated companies, or subcontractors, and I DO HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD MAVERICK and its agents, employees, officers, directors, associates, affiliated companies, and subcontractors HARMLESS against any and all liability, actions, causes of action, debts, suits, claims, and demands of any and every kind and nature whatsoever which I now have or which may hereafter arise out of or in connection with my trip or participation in any activities arranged for me by MAVERICK and its agents, employees, associates, affiliated companies, or subcontractors. THE TERMS OF THIS AGREEMENT SHALL SERVE AS A COMPLETE RELEASE AND EXPRESS ASSUMPTION OF RISK for myself, my heirs, assignees, administrators, executors, and all members of my family, including any minors accompanying me. I acknowledge that in calculating the cost of the tour or trip, MAVERICK has relied on my consent to these terms and on their enforceability. In the absence of this Release, the tour/trip cost would have been higher, or, alternatively, MAVERICK would be unable to offer these services.

I understand that MAVERICK reserves the right to take photographic or film records of any of its trips and hereby agree that MAVERICK may use any such photographic or film records for promotional and/or commercial purposes, as well as approve such use by third parties whom MAVERICK may engage in joint marketing, without remuneration to me any my agents. I hereby assign all right, title, and interest I may have in or to any and all media in which my name or likeness might be used by MAVERICK.

I understand that MAVERICK reserves the right to refuse as a trip or event participant, or remove from a trip, any person it judges to be incapable of meeting the rigors and requirements of participating in the activities, or who it determines to detract from the enjoyment of the trip by others, or who it determines to be engaging in illegal activities such as drug use. I agree to follow all written and verbal rules of safety presented to me by MAVERICK.

I understand that MAVERICK firmly believes in respect towards all people, cultures and natural environments. MAVERICK guests are expected to behave in a respectful manner with regard to fellow guests, trip leaders, tour guides, service providers, the general public and to the natural environment. Since many trips are international, it is especially important for guests to be sensitive and respectful with regard to people of all races, ethnicities, nationalities, religious beliefs, cultural backgrounds and traditions. I understand that MAVERICK reserves the right to protect its brand by refusing as a trip or event participant, or removing from a trip, any person it judges to be harmful to others or to the natural environment.

I have fully read and understood the conditions set forth in the preceding document. I fully and unconditionally accept these terms and conditions, and understand that their violation may entail an interruption of his or her participation in the tour, without refund. I understand that my participation on a tour may be terminated without refund if MAVERICK determines, at its sole discretion, that the conduct of the guest is incompatible with the goals, interests, harmony, or integrity of the MAVERICK brand, or with the interests or well-being of other guests. I agree to indemnify MAVERICK if my actions cause MAVERICK and its affiliates to sustain financial loss, damages or liability.

MAVERICK reserves the right to make route, hotel, itinerary and trip modifications as required or desirable to improve the trip quality and/or to accommodate the comfort and well-being of guests.

I HAVE READ AND FULLY UNDERSTAND THE PROVISIONS AND THE LEGAL CONSEQUENCES OF THIS RELEASE, ASSUMPTION OF RISK, AND PARTICIPATION CONDITIONS, AND I HEREBY AGREE TO ALL OF ITS TERMS AND CONDITIONS. I ACKNOWLEDGE THAT MAVERICK HAS RECOMMENDED THAT I HAVE MY ATTORNEY REVIEW THIS RELEASE PRIOR TO MY SIGNING IT.

MAVERICK desires to maintain friendly relationships with its clients (agents, sellers, buyers, etc.). In order to provide for a mutually beneficial relationship, MAVERICK has established an alternative mediation program in the event of a misunderstanding or dispute between MAVERICK and it clients. If a dispute arises out of or relates to this contract, or breach thereof, and if the dispute cannot be settled through negotiation, the parties agree first to try in good faith to settle the dispute by mediation administered by the World Travel Dispute Center under the applicable guidelines as established by International Forum for Travel and Tourism (IFTTA) before resorting to arbitration, litigation, or some other dispute resolution procedure. If mediation is not successful, the parties will settle by binding arbitration administered by the World Travel Dispute Center under the applicable guidelines as established by IFTTA. Judgment on the award rendered by the arbitrator(s), or written agreements of the parties, may be entered in any court having jurisdiction thereof or written agreements of the parties. If litigation is necessary to enforce this agreement, the prevailing party(s) shall receive costs and attorney's fees.
